Terms of use
These terms govern the use of the Fesa ID platform, operated by Formas Eficientes, S.A., both by organizations issuing credentials and by people who hold a credential or an account.
Draft pending legal review. This notice disappears once the text is approved.
1. The service
Fesa ID lets an organization design, issue and manage digital credentials (ID badges, business cards, insurance member cards, event credentials) reachable through a QR code, a link and Apple Wallet and Google Wallet passes, and lets third parties verify that they are valid.
The service is contracted per organization through a specific proposal and contract. Pricing, implementation scope and service levels are set in that contract.
2. Accounts
Each account is personal. You are responsible for keeping your password confidential and for everything done with your account. Report any unauthorized access to your organization or to Fesa immediately.
Fesa may require two-factor authentication from administrators and suspend accounts on signs of misuse.
3. Responsibilities of the issuing organization
- Hold a valid legal basis and, where applicable, each holder's consent before issuing a credential with their data.
- Keep credential data up to date and suspend or revoke credentials that stop being valid.
- Appoint administrators and answer for the actions they take on the platform.
- Comply with Law 81 of 2019 and any sector regulation that applies to it as data controller.
4. Acceptable use
You may not:
- Issue credentials on behalf of people or organizations without authorization, or credentials that could be mistaken for official identity documents.
- Attempt to access other organizations' data, bypass access controls or tamper with the platform.
- Use the platform to send unsolicited communications or for unlawful purposes.
5. Intellectual property
The platform, its code and its base designs belong to Fesa. Logos, brands and data uploaded by an organization remain the organization's, which grants Fesa a limited license to display them on the credentials and passes it issues.
6. Availability and support
Fesa strives to keep the service continuously available and takes daily backups. Maintenance windows affecting availability are announced in advance. Committed service and support levels are detailed in each organization's contract.
7. Limitation of liability
A digital credential attests what the issuing organization declares; Fesa does not verify holders' identity nor guarantee the accuracy of data uploaded by the organization. To the extent permitted by law, Fesa is not liable for decisions third parties take based on reading a credential, nor for indirect damages.
8. Termination
When the contract with an organization ends, Fesa returns or deletes its data as agreed in the data processing agreement. That organization's credentials stop resolving and its passes become invalid.
9. Governing law
These terms are governed by the laws of the Republic of Panama. Any dispute is submitted to the competent courts of Panama City, unless the organization's contract provides otherwise.
